These Terms of Use (hereinafter "Terms") govern the use of the Kusalia mobile application (hereinafter "the App"), published by JDevelop, a French limited liability company (EURL), registered under SIRET 938 123 072 00010, headquartered at 6 place du Président Thomas Woodrow Wilson, 31000 Toulouse, France, represented by Jean-Denis VIDOT, Managing Director.

Acceptance of Terms

By using the App, you fully accept these Terms. If you do not agree with these conditions, please do not use the App.

Description of the service

Kusalia is a hydration tracking app that allows you to:

• Record your daily beverage consumption
• Track your progress toward a customizable goal
• View hydration statistics
• Receive hydration reminders

Kusalia Pro

The App offers a free version and a premium version (Kusalia Pro) available through subscription. Pro features include:

• Monthly, yearly, and all-time statistics
• Detailed consumption history
• Customizable reminders
• Unlimited custom beverages
• Home screen widgets

Subscriptions and payments

• Subscriptions are managed by Apple (App Store) or Google (Play Store) depending on your platform.
• A 7-day free trial may be offered to new subscribers.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription from your store settings (App Store or Play Store).
• No refund will be issued for the current subscription period in case of cancellation.

Use of the App

Kusalia is a personal tracking tool. The App does not constitute medical advice and is not a substitute for consulting a healthcare professional. Hydration recommendations are provided for informational purposes only.

Intellectual property

All elements of the App (design, code, icons, text, sounds) are protected by intellectual property law. Any reproduction, modification, or distribution without authorization is prohibited.

Personal data

The processing of personal data is described in our Privacy Policy.

Limitation of liability

• The App is provided "as is", without warranty of any kind.
• We do not guarantee the accuracy of tracking data or statistics.
• We are not responsible for data loss resulting from uninstallation, device change, or data reset.
• We are not responsible for health decisions made based on information provided by the App.

Changes

We reserve the right to modify these Terms at any time. Changes take effect upon publication. Continued use of the App after modification constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by French law. Any dispute relating to the use of the App shall be subject to the jurisdiction of the French courts.
